PREAMBLE

At hype SWISS, we believe that Swiss telecommunications can combine simplicity, clarity, performance and brand energy.

Designed for individuals and businesses alike, the hype SWISS experience is intended to be accessible, clear and contemporary, with a confident, positive and dynamic approach to Mobile, Landline, Wi-Fi, TV and combined offers.

In this spirit, and as part of the launch of its commercial and event activities in Geneva, hype SWISS Sàrl is organising a free promotional prize draw to celebrate the arrival of the hype SWISS Center and bring the hype SWISS experience to the public through a generous, festive and transparent promotion.

The purpose of these Official Rules is to govern this prize draw in accordance with Swiss law, under rules that are clear, fair and binding on all participants.

Article 1 - ORGANISER

Hereinafter referred to as the ‘Organiser’.

Article 2 - PURPOSE OF THE PRIZE DRAW

As part of its promotional, commercial and event activities, the Organiser is holding a free prize draw under the hype SWISS brand, enabling validly registered participants to be entered into a random draw to win various prizes.

These Official Rules set out fully and bindingly the conditions of entry, the organisational arrangements for the prize draw, the rules governing the draw, the conditions for awarding the prizes, and the respective rights and obligations of participants and the Organiser.

Article 3 - PROMOTION, COMMUNICATION AND EXTERNAL MEDIA COVERAGE

This prize draw may be promoted, communicated or publicised with the support of external media organisations and distribution partners, including, without limitation, radio, television, social networks, digital platforms, online media, printed materials, displays, event partners, content creators, influencers or any other communication channel.

The sole purpose of such coverage, announcements, publications, broadcasts or statements is to publicise and promote the prize draw to the public.

Unless expressly stated otherwise, these external parties do not act as organisers of the prize draw and accept no responsibility for its organisation, management or operation, the draw, the awarding of prizes, the handling of complaints or the interpretation of these Official Rules.

The Organiser remains solely responsible for the official content of these Official Rules, the conditions of entry, the management of the prize draw, the selection of winners and the awarding of prizes.

Article 4 - FREE ENTRY

Entry to the hype SWISS Grand Prize Draw is entirely free, with no purchase necessary. It is not conditional upon any monetary stake, product purchase, order, paid subscription, payment, advance payment, premium-rate telephone call or SMS, registration fee, activation fee or legal transaction for consideration. No participant may purchase additional chances or submit repeat entries in exchange for payment.

Providing only the data required to administer the prize draw does not constitute financial or contractual consideration. Newsletter subscription, consent to marketing and any interaction with social networks are optional and separate. Refusal does not reduce the validity of the ticket, its weighting factor or the possibility of winning.

The promotion is temporary, limited to the period specified in Article 9 and designed to present no risk of excessive gambling. As no monetary stake or legal transaction for consideration is involved, it is organised as a free promotional prize draw that does not constitute gambling within the meaning of the Federal Act on Gambling (Gambling Act; SR 935.51). Should a competent authority adopt a different classification, the Organiser will implement any adaptations or authorisations required by mandatory law before continuing the promotion. The authorities’ final classification remains reserved.

Article 5 - FULL ACCEPTANCE OF THE OFFICIAL RULES

By entering, each participant accepts these Official Rules. The Rules are made available before the entry is validated, in a form that the participant can consult and retain.

The participant agrees to comply with the Rules insofar as they are compatible with mandatory provisions of law. No acceptance shall constitute a waiver of any right that may not legally be excluded.

Article 6 - PRECEDENCE OF THE OFFICIAL RULES

These Official Rules, in their published and dated version, are the official reference document for the hype SWISS Grand Prize Draw. Advertisements, social-media posts, videos, spots, partner content and abridged presentations serve an informational or promotional purpose.

In the event of any discrepancy, these Official Rules shall prevail, subject to participants’ mandatory rights under Swiss law. Promotional material cannot create a prize, benefit or condition not included in the Rules, except through an express written undertaking by the Organiser or the transparently communicated correction of an obvious error.

Article 7 - GENERAL CONDITIONS OF ENTRY

The prize draw is open exclusively to natural persons aged 18 or over who are resident in Switzerland at the time of entry and remain resident in Switzerland when the prize is awarded. Entry is personal.

For an entry to be valid, the participant must enter before the deadline, complete the official form, provide accurate, complete and usable information, have a valid means of contact, accept these Official Rules, hold only one ticket and use no automated, fictitious, misleading or fraudulent process.

The following are excluded: the Organiser’s governing bodies, employees and agents who are directly involved in the prize draw; service providers, advisers and persons with access to its preparation, the participant list, the algorithm, the control or the result of the draw; and members of their households where their participation could compromise impartiality. Fictitious identities, multiple entries and any person who does not meet the conditions of these Official Rules are also excluded.

Exclusions are applied based on objective and verifiable criteria, proportionately, without unlawful discrimination and subject to mandatory law.

Article 7bis - AGE REQUIREMENT AND SUPPORTING DOCUMENTS

Minors are not eligible to enter. The Organiser may ask a selected participant for an official identity document and recent proof of residence, solely to the extent necessary to verify age, identity, residence and eligibility.

An unjustified refusal to provide reasonably requested evidence, an inability to establish eligibility or a material discrepancy with the entry data will, following verification, result in the loss of entitlement to the prize. The prize may then be awarded to a reserve winner or redrawn.

Article 8 - ENTRY PROCEDURE

Entries may be submitted only through the official form or mechanism made available by hype SWISS.

The time recorded by the Organiser’s systems shall determine compliance with the deadline, subject to proof to the contrary. An entry is deemed received only after it has been recorded in the system; where issued, the participant must retain the entry confirmation.

Only one entry and one ticket are permitted per person, regardless of the number of email addresses, telephone numbers, social-media accounts, devices or forms used. The Organiser may proportionately cross-check the participant’s surname, first name, date of birth, address, email address, telephone number and strictly necessary technical indicators in order to prevent duplicate entries and fraud.

Newsletter subscription, following hype SWISS accounts, likes, shares, comments, tags and any other social- media action are entirely optional. They do not create an additional ticket or weighting factor and are not a condition of entry, inclusion in the draw or receipt of a prize.

An incomplete, late, manifestly incorrect, automated, fictitious, duplicate or fraudulent entry may be suspended and then invalidated after reasonable verification. In the event of serious ambiguity, the Organiser may request an explanation before deciding.

Article 9 - ENTRY PERIOD

The prize draw opens on the date of its official launch as communicated by hype SWISS. Entries close definitively on Friday, 25 September 2026 at 11:59 p.m., Swiss local time. The Organiser’s timestamped server records determine the order and time of receipt, subject to proof to the contrary.

No new entry received after this deadline will be accepted. The closing time for the attendance check that qualifies for the x10 weighting factor will be announced before the draw on the official channels and at the event venue.

Article 10 - PRIZES OFFERED

The Grand Prize Draw comprises 75 individual hype SWISS subscription prizes divided into eight families: Melon – Mobile Premium; Papaya – Mobile Europe; Strawberry - Internet 10G; Apple – Internet 50; Persimmon - TV Top 2.0; Tangerine – TV Classic 2.0; Lemon – Flat Plus Telephony; Grapefruit – Total Package.

These 75 individual prizes are supplemented by five distinct premium MAJOR PRIZES of decreasing value. Each combines a long-term hype SWISS subscription with a selection of products and, depending on the prize, services or a hype SWISS Center experience.

The subscriptions and equipment included in the five MAJOR PRIZES are removed from the other categories and are not counted twice. Total number: 80 prizes, for up to 80 distinct winners. Total indicative retail value: CHF 257'600.46. The detailed list appears in Appendix 1.

The values are indicative, include VAT where applicable and are based on the reference prices available in September 2026. They confer no right to a cash payment. Prizes are personal, non-refundable, not convertible into cash and not exchangeable for their monetary value.

A prize subscription must be activated within 90 days of final confirmation of the win.

Activation is subject to a technically eligible Swiss address, any identity checks required by law or contract and, depending on the service, network availability. The free period runs continuously from activation and may not be suspended, split or transferred without the Organiser’s written consent.

Conditions applicable to prizes

If, before the free period expires, the winner requests on their own initiative that the prize subscription be replaced by another hype SWISS subscription, regardless of its nature or value, the Organiser will first inform the winner, on a durable medium, of the price, effective date and conditions applicable to the new subscription. The change will take effect only after the winner’s express confirmation.

On the effective date of the expressly confirmed change, the free-of-charge benefit attached to the prize subscription will end definitively for the entire remaining period. The winner must then pay the full price of the new subscription selected, in accordance with the price and conditions accepted, without the prize value being credited and without any credit for the unused free period. Any cancellation of the prize subscription requested before its expiry will likewise end the remaining benefit for the future, without indemnity, reimbursement, credit note, cash conversion, transfer or any other form of compensation, subject to mandatory rights.

These consequences do not apply where a migration, technical adaptation or replacement is decided by the Organiser because an offer has evolved, become unavailable or been withdrawn. In that event, the remaining free period will be preserved in accordance with these Official Rules.

The monthly charges for the service expressly won are waived throughout the announced period.

Out-of- plan usage, options, premium content, accessories, call-outs and additional services requested by the winner remain payable by the winner after prior disclosure. Standard delivery within Switzerland of equipment requiring shipment is paid by the Organiser; any special delivery arrangement requested by the winner may be charged following acceptance.

Products and equipment are awarded in the advertised version or, if unavailable, in a replacement version selected by the Organiser in accordance with these Official Rules.

The winner has no right to an exchange for personal preference or to a change of model, colour, capacity, configuration or category.

The Organiser remains free to accept or refuse such a request.

If the winner requests on their own initiative that a prize product be replaced by another product, regardless of its nature or value, and the Organiser exceptionally accepts that request, the full price, specifications and conditions of the new product will be communicated to the winner in advance on a durable medium. The change will take effect only after the winner’s express confirmation. Upon such confirmation, the winner definitively relinquishes the product originally won and agrees to pay the full price of the new product selected, with no deduction, set-off, credit note or credit corresponding to the value of the prize product. If the original product has already been delivered, the Organiser may make its consent conditional upon the product being returned beforehand, complete and undamaged, at the winner’s expense.

Refusal of the prize product, failure to collect it, cancellation of delivery or its voluntary return accepted by the Organiser gives no right to any indemnity, reimbursement, credit note, exchange, cash conversion, transfer or other compensation. These rules apply neither to a replacement decided by the Organiser because of unavailability nor to the exercise of mandatory rights relating to a defect, conformity, product safety or a legally applicable warranty.

There is no automatic paid continuation when the free period expires. Any paid continuation requires a separate contract and the winner’s express consent. A price change does not reduce the free period. If an offer or product version is discontinued, the Organiser will, insofar as reasonably possible, provide an offer, model or service of comparable or greater value. Mandatory statutory warranties and, where applicable, the manufacturer’s warranty remain reserved.

Article 11 - DATE, TIME AND VENUE OF THE PRIZE DRAW

The public prize draw will take place on Saturday, 26 September 2026 at the hype SWISS Center, 12 rue des Gares, 1201 Geneva, Switzerland. The exact time will be announced on the official hype SWISS channels.

After entries have closed, the list of eligible entries will be frozen, timestamped, checked for duplicates and retained with the relevant technical logs. Any subsequent correction must be justified and traceable. The draw will be conducted using an auditable random-number generator or a physical process producing an equivalent random result.

Physical attendance is not required to enter or win. Every valid ticket receives an x1 weighting factor.

The same ticket receives an x10 weighting factor if its holder is physically present, identifies themselves in person and completes check-in before it closes. A proxy, an attendance declaration by a third party or check- in after the deadline has no effect.

Access to the draw venue remains subject to venue capacity, safety instructions, respect for staff and other visitors, and instructions issued by the authorities. Refusal of admission or evacuation that is objectively justified on safety grounds does not invalidate a valid entry: the ticket will then retain its x1 weighting factor, unless fraud or another established ground for exclusion applies.

The x10 weighting factor multiplies the weight of the ticket by ten, without creating ten independent entries and without guaranteeing a win. The absolute probability depends on the total number of admitted x1 and x10 tickets.

The draw is conducted without replacement: once a ticket is selected and its holder declared a winner, that ticket and all its occurrences are permanently removed. A participant may win only one prize.

Prizes are drawn in descending order of retail value. The procedure, weighting parameters, winners and any reserve winners are recorded in minutes or a draw log retained by the Organiser. The draw is supervised by at least two people, including one person who did not single-handedly configure the selection mechanism.

Article 12 - PARTICIPANTS PRESENT AND ABSENT - NOTIFICATION OF WINNERS

An absent participant retains a valid ticket with an x1 weighting factor. A participant who is present and properly checked in retains the same single ticket with an x10 weighting factor. Both are eligible to win.

During the public announcement, the Organiser may disclose the ticket number together with the winner’s first name and the initial of their surname. Any broader identification or individualised promotional use is governed by Article 17.

An absent winner will be notified using the contact details provided at entry, by written message or another durable medium stating at least the prize concerned, how to accept it, the reasonably required supporting documents, the response deadline and the consequences of failing to respond. The Organiser will retain proof that the notice was sent and, insofar as reasonably possible, send a reminder before the deadline.

The winner has 30 calendar days to respond, expressly accept the prize, confirm their identity and provide the information reasonably required. The period begins on the day after receipt of the notice or, where the date of receipt cannot be established, on the day after its documented electronic availability at the validly supplied address, provided that the Organiser has received no delivery-failure notice.

The Organiser is not required to seek contact details other than those provided at entry.

An incorrect or inactive address, a full mailbox or spam filtering attributable to the winner does not suspend the period. If the Organiser receives a delivery-failure notice and has another validly supplied means of contact, it will make a further attempt; the period will then begin from that new notice.

If the winner fails to complete the required steps within the 30-day period, the winner will definitively lose all rights relating to the prize concerned, subject to a proven non-culpable impediment reported without delay or a contrary mandatory right. Such forfeiture is treated as a waiver of the prize within the meaning of Article 13 and gives no right to compensation of any kind. The prize may be awarded to a reserve winner selected by the same process or redrawn; the first winner’s ticket remains permanently excluded from all other draws.

In the event of express refusal, ineligibility, inability to verify identity or a material breach of the Rules, the prize may also be reallocated or redrawn in accordance with this Article and Article 13.

Article 13 - AWARD AND DELIVERY OF PRIZES

Prizes will be delivered, shipped, activated, installed or made available according to their nature and the arrangements communicated to the winner. The winner must cooperate in good faith, provide any reasonably required documents and, for a subscription, request activation within 90 days of final confirmation of the win.

Prizes are awarded personally. Any transfer to a third party requires the Organiser’s prior written consent. Where activation depends on coverage, infrastructure, an authorisation or a regulatory condition that cannot be met, the Organiser may offer a technology, plan, item of equipment or service of equal or greater value.

The winner remains free to waive the prize before its delivery or activation. Any waiver must be express, clear and unequivocal and must be sent to the Organiser in writing or on another durable medium. It becomes final upon receipt by the Organiser, terminates for the future all rights to the prize and its components, and does not permit the ticket to be reintroduced into the draws. The Organiser may then award the prize to a reserve winner or conduct a new draw.

In the event of a waiver, no compensation of any kind is due. In particular, the winner may not claim any payment, compensation, reimbursement, credit note, exchange, replacement prize or service, deferral, transfer, cash conversion or other compensatory benefit. If the prize or any of its components has already been delivered, activated or performed, any return, deactivation or early termination requires the Organiser’s prior
consent and will take place, unless a mandatory right provides otherwise, at the winner’s expense and risk, without reviving any right to compensation.

This clause governs only a voluntary waiver of the prize. It does not constitute an advance waiver of the winner’s mandatory rights and does not limit any liability that cannot be excluded under Swiss law, including in the event of intent or gross negligence attributable to the Organiser, a defect, non-conformity, a safety issue or a legally applicable warranty.

Additional services expressly requested by the winner and not included in the prize will be performed only after the price has been disclosed and remain payable by the winner.

The end of the free period does not result in an automatic paid subscription; any subsequent commitment requires express consent and a separate contract.

Article 14 - PROHIBITED CONDUCT AND EXCLUSION

The following are prohibited in particular: multiple entries, false identities, impersonation, fake accounts, automated processes, forged supporting documents, manipulation of check-in or the x10 weighting factor, interference with the draw, attempts to keep or reintroduce a winning ticket, and any collusion intended to undermine fairness.

Where there are objective indications of a breach, the Organiser may suspend an entry or award while carrying out a proportionate review, request explanations or supporting documents, and then cancel the entry, withdraw the x10 weighting factor or refuse the prize if the breach is established. A minor good-faith error that does not affect eligibility or fairness will be corrected where reasonably possible.

In the event of established fraud, the Organiser may demand the return of the prize or its value, claim proven losses and notify the competent authorities. These measures are subject to proportionality, good faith and the participant’s mandatory rights.

Article 15 - PERSONAL DATA

hype SWISS Sàrl, 12 rue des Gares, 1201 Geneva, acts as data controller. The following data may be processed as required: identity and contact data, date of birth, address, entry and ticket data, attendance status, weighting factor, proof of eligibility, draw results, correspondence relating to the prize and technical security logs.

The purposes are to record and validate entries, prevent duplicate entries and fraud, manage check-in and the draw, identify and notify winners, deliver and administer prizes, handle complaints, maintain security and evidence, and comply with legal obligations. Only adequate and necessary data are collected.

Data may be disclosed to authorised staff; strictly necessary IT, hosting, draw, delivery, installation or advisory service providers; and authorities where required by law. Service providers are subject to appropriate confidentiality and data-protection obligations. Any transfer abroad is carried out in accordance with the Federal Act on Data Protection, including to a country recognised as providing adequate protection or using appropriate safeguards.

Unless an obligation or dispute justifies longer retention, non-winners’ data will be deleted or anonymised no later than 90 days after the complaint’s deadline expires.

Winners’ data will be retained throughout performance of the prize and then for the applicable statutory evidence and retention periods. Copies of identity documents will be deleted as soon as they are no longer required for verification or a legal obligation.

Any data subject may exercise the rights provided by law, including requesting access to, rectification or deletion of their data and, where applicable, objecting to processing or obtaining their data.

Requests may be sent to hype@hype.swiss. The privacy policy published on the official hype.swiss website supplements this Article; the right to refer a matter to the Federal Data Protection and Information Commissioner or the competent courts remains reserved.

Article 16 - MARKETING COMMUNICATIONS

Entry into the prize draw and newsletter subscription are two separate actions. Participants are free to choose whether or not to receive hype SWISS marketing communications.

Any marketing consent must be separate from acceptance of the Rules, result from an affirmative action, not be pre-selected, specify the intended communications and be freely withdrawable. The Organiser retains evidence of consent where required by law and includes a simple means of unsubscribing in every electronic communication.

Refusal or withdrawal of consent does not cancel the entry or ticket, or the x10 weighting factor obtained in accordance with these Official Rules. Data will not be transferred to third parties for their own marketing without separate consent or another valid legal basis.

Article 17 - MAGE RIGHTS AND COMMUNICATIONS CONCERNING WINNERS

The draw takes place as part of a public event. General photographs and video footage may be taken in accordance with applicable law, with visible information provided at the venue and reasonable measures enabling persons who do not wish to be individually identified to indicate this.

The announcement of a winner may be limited to the ticket number, first name and initial of the surname. Any wider publication of the winner’s identity, portrait, voice, testimonial or photograph for individualised promotional purposes requires, where applicable, separate, freely given, specific authorisation that is revocable for the future.

Refusal or withdrawal of an image-use authorisation does not cancel the entry or result in loss of the prize.

Article 18 - TAXATION

Winnings from promotional prize draws may have tax consequences depending on their nature, value and the law in force. In September 2026, the generally applicable federal exemption for winnings from sales- promotion games is limited to CHF 1’100.-; this information is indicative and may change.

Each winner remains responsible for their personal tax position. The Organiser will fulfil any reporting or withholding obligations imposed on it by law and may provide the winner with a statement describing the nature and indicative value of the prize. Any taxes or charges legally payable by the winner remain the winner’s responsibility.

Article 19 - GENERAL LIABILITY

To the extent permitted by law, the Organiser is not liable for network interruptions, failures of third-party services, participant input errors, inaccurate contact details, spam filtering, technical unavailability, delivery incidents not attributable to the Organiser, official measures, force majeure or unexpected product unavailability, provided that it has taken reasonable measures to preserve the proper conduct of the prize draw.

To the extent permitted by law, indirect or consequential loss is excluded, including loss of profit, opportunity or data, where it is not directly attributable to a culpable breach by the Organiser. Mere disappointment at not winning does not constitute compensable loss.

Nothing in these Official Rules limits liability that cannot be excluded under Swiss law, including liability in the event of intent or gross negligence, death or personal injury, product liability or other mandatory rights. The Organiser will take reasonable measures to limit the consequences of an incident and restore a fair process.

Article 20 - LIMITATION OF LIABILITY FOR EXTERNAL MEDIA

Radio stations, television channels, media organisations, influencers, partners and social platforms that publicise the prize draw are neither organisers nor responsible for the draw or delivery of prizes, unless expressly agreed otherwise in writing. Facebook, Instagram, TikTok and other platforms do not sponsor, administer or endorse the prize draw.

Participants remain subject to the terms of use of any third-party services they choose to use. A failure or action by a third party does not automatically invalidate the prize draw if the Organiser implements a reasonable solution and preserves equal treatment.

Article 21 - CLARIFICATION, ADAPTATION AND AMENDMENT

The Organiser may clarify or adapt the arrangements only for an objective reason, including a legal or official requirement, a security threat, fraud, a failure, product unavailability, technical impossibility or force majeure. Every decision must be necessary, proportionate, documented and consistent with good faith.

Any material amendment will be dated, versioned and published on the official channels. It may not arbitrarily and retrospectively reduce chances already acquired or the value of a prize. In the event of replacement, value and utility will be maintained at an equal or higher level insofar as reasonably possible.

Cancellation or postponement will occur only in the event of objective impossibility or a requirement imposed by an authority. Participants will be informed appropriately. No compensation is due merely because of a lawful adaptation, postponement or cancellation, subject to loss attributable to a fault of the Organiser and to mandatory rights.

Article 22 - SEVERABILITY

If any provision of these Official Rules is held to be void, invalid or unenforceable, in whole or in part, the remaining provisions will remain in full force and effect.

Article 23 - GOVERNING LAW AND JURISDICTION

These Official Rules are governed exclusively by Swiss law.

Subject to any mandatory place of jurisdiction provided by law, any dispute relating to this prize draw, its interpretation or performance, or the awarding of prizes, will be submitted to the competent courts of the Canton of Geneva.

Article 24 - GOVERNING VERSION

These Official Rules were originally drafted in French.

In the event of any translation, editorial adaptation, summary, publication in another language or publication in abridged form, the full French version of these Official Rules alone shall prevail.

Article 25 - OFFICIAL INFORMATION AND CONTACT

Any enquiry or complaint relating to the prize draw may be sent to hype SWISS Sàrl, 12 rue des Gares, 1201 Geneva, Switzerland; email: hype@hype.swiss; telephone: +41 22 404 05 55.

To permit an effective review, any complaint must be submitted in writing, state the reasons, include the ticket number and available supporting information, and be received within 30 days of the draw or, for a winner, notification of the disputed decision.

This internal deadline does not extinguish any mandatory right or longer statutory period.
